Official Rules

1. Eligibility. NO PURCHASE NECESSARY TO ENTER OR WIN. SIERRA ONLINE, A DIVISION OF VIVENDI GAMES, INC. ("SPONSOR") IS THE SPONSOR OF THIS BATTLESTAR GALACTICA SWEEPSTAKES ("SWEEPSTAKES"). THIS SWEEPSTAKES IS OPEN ONLY TO RESIDENTS OF THE UNITED STATES WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AS OF NOVEMBER 1, 2007 ("ENTRANTS"). IF YOU ARE NOT A RESIDENT OF THE UNITED STATES AND/OR YOU ARE NOT EIGHTEEN (18) YEARS OF AGE OR OLDER YOU ARE NOT ELIGIBLE TO WIN A PRIZE. To be eligible to win a prize, entries must be completed and received by Sponsor in the format designated below. Directors, officers and employees of Sponsor, its parent, and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, and immediate families of each are not eligible to win any prizes. All applicable federal, state and local laws and regulations apply. Offer void where prohibited. In the event of any dispute, entries will be deemed to have been submitted by the owner of the e-mail address from which the e-mail was sent.

2. Disclaimer. Sponsor, all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; © any Sweepstakes disruptions, injuries, losses or damages caused by events beyond the control of Sponsor; or (d) any printing or typographical errors in any materials associated with the Sweepstakes.

3. Sweepstakes Period. The Sweepstakes shall commence on November 1, 2007 at 12:01 AM Pacific Time ("PT"), and end on November 1, 2008 at 11:59 PM PT ("Sweepstakes Period").

4. Prize. Twelve (12) qualified entrants ("Prize Winner(s)") shall each win Fifty Two Thousand (52,000) Microsoft® Points (each Prize package valued at US $650.00) which may be awarded in the form of either: (i) thirteen (13) Microsoft Points prepaid cards, each worth Four Thousand (4,000) Microsoft Points, or (ii) a unique code which the Prize Winner may redeem for Fifty Two Thousand (52,000) Microsoft Points. The Microsoft Points are redeemable for online transactions via the Microsoft Xbox LIVE® Marketplace and are subject to applicable terms, conditions and restrictions. Prize Winner acknowledges that the Microsoft Points can only be used in conjunction with the Microsoft Xbox 360® video game and entertainment system (sold separately). Prize Winner shall be responsible for costs of internet access and establishing an account with Microsoft Xbox LIVE® Marketplace as required to redeem the Microsoft Points. Further, Prize Winner acknowledges that redemption of the Microsoft Points is subject to the Microsoft terms of use with respect to Xbox LIVE® Marketplace and any applicable terms, conditions or restrictions set forth in connection with the Microsoft Points and/or the Microsoft Xbox 360® video game and entertainment system.

Odds of winning a prize depend on number of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER.

All prizes will be awarded. Prize Winners will be required to execute an affidavit of eligibility before they can receive their Prize. Thereafter, a Prize Winner will be shipped the Prize within thirty (30) days of being qualified as the winner of the Sweepstakes. Limit one (1) Prize per eligible Entrant. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose)

5. How to Enter.

6. Determination of Winners. Drawings for prizes will take place on the first day of each month during the Sweepstakes Period, with the first drawing on December 1, 2007 and the final drawing on November 1, 2008 (each a "Monthly Drawing"); one Prize Winner per Monthly Drawing. Each Monthly Drawing shall include eligible entries received within the month immediately preceding the date of the drawing; entries for each Monthly Drawing must be received by 11:59 P.M. Pacific on the last day of the respective month immediately preceding the date of the drawing. Non-winning entries remaining after each drawing will be carried over to the next drawing until November 1, 2008. Prize Winners will be notified by e-mail within fourteen (14) days after each Monthly Drawing. All notifications shall be sent via email to the email address submitted by the respective Prize Winner in their entry form. To claim a prize, winners should follow the instructions contained in their email notification. Prizes returned as undeliverable or otherwise not claimed within fifteen (15) days after delivery of notification will be forfeited and awarded to an alternate winner. Each Entrant may only win once during the Sweepstakes Period; odds of winning depend on the number of entries received each month.

7. Collection of Information. The information collected to enter the Sweepstakes will be used to contact you in the event that you are chosen to receive a prize. Additionally, Sponsor will use this information for marketing purposes, and to contact you regarding offers, promotions and other sweepstakes related to this and/or other products distributed by Sponsor. As stated above, the Sweepstakes is not open to minors under the age of eighteen (18). In the event that you are under the age of eighteen (18) years and submit an entry to Sponsor, Sponsor will delete, erase or destroy any and all personally identifiable information that is obtained from the entry.

8. General Release. By entering the Sweepstakes, you release Sponsor, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

9. Affidavit & Release. As a condition of being awarded any prize, winners will be required to execute, have notarized, and deliver to Sponsor an Affidavit of Eligibility (as provided by Sponsor), which includes an acceptance of these Official Rules and a release of liability. Failure to do so within the time set forth in each winner's email notification will result in disqualification of the winner and an alternate winner will be selected to receive the Prize. Additionally, the winner agrees that entry and/or acceptance of Prize/s constitutes permission for the Sponsor and their agencies to use the winner's name, address (city and state) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known or hereafter devised, including without limitation Internet, unless prohibited by law.

10. Winners List/Rules Request. For a copy of the winners list, send a stamped, self-addressed, business-size envelope after December 1, 2008 to Sponsor at the following address: BATTLESTAR GALACTICA Sweepstakes -Winners List, c/o Vivendi Games, 6060 Center Drive, 5th Floor, Los Angeles, CA 90045. To obtain a copy of these rules, send a stamped, self-addressed business-size envelope to Sponsor at the following address: BATTLESTAR GALACTICA Sweepstakes -Rules Request, c/o Vivendi Games, 6060 Center Drive, 5th Floor, Los Angeles, CA 90045. Residents of WA and VT may omit return postage.

12. Miscellaneous. The Sweepstakes and these Official Rules will be governed, construed and interpreted under the laws of the United States. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Sweepstakes or any Entrant's participation in the Sweepstakes should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Sweepstakes or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Sweepstakes as planned. Entrants who violate these Official Rules, attempt to defraud or tamper with the operation of the Sweepstakes or engage in any conduct that is detrimental or unfair to Sponsor, the Sweepstakes or any other Entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Sweepstakes and may be prosecuted to the full extent of the law. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Sweepstakes.
